    Prenuptial and Post-Nuptial Agreements

Unless you and your spouse make a legally binding agreement otherwise, your state laws dictate the property rights in the event of divorce.

Prenuptial agreements and postnuptial agreements serve essentially the same purpose. Prenuptial signifies an agreement created before a marriage or civil union; a postnup is created thereafter. Many couples today hire lawyers to prepare prenuptial and postnuptial agreements for a number of reasons:

    • To define particular assets acquired during the marriage as separate property or as part of the marital estate
    • To ensure that children from previous relationships inherit certain assets or property from a parent
    • To establish how property will be divided in the case of divorce
    • To protect against debt liability
    • To define financial responsibilities for each party during the marriage

While it is possible to draft a prenuptial or postnuptial agreement without a lawyer, it’s important not only to consider the many nuances of the law, but to consider the potential consequences. While it may be drafted under positive circumstances, these are a legally binding documents examined under scrutiny during circumstances that are often quite different. Additionally, courts may be reluctant to enforce a prenup or postnup if either party did not have adequate legal representation.

Attorney Mark McGowan will work with you to draft a prenuptial or postnuptial agreement, customized to meet your needs, that will stand up in court and protect your assets the way you intended.

We were looking for 4 key things when looking for a lawyer to assist us with our prenuptial agreement –

    1) Knowledgeable
    2) Trustworthy
    3) Quick (we only had a month to the day from initial contact to our elopement date)
    4) Able to do the work remotely until the point of signing (as we are about a 1.5 hr drive, and have a newborn at home)

Mark checked off all these boxes and more. He was so quick, efficient, and meticulous in drafting our prenuptial agreement. He made a couple of slight adjustments to our agreement to fit our specific needs and tackled all our questions with ease. We are so grateful for Mark and his expertise and excited to begin our married life worry free!

Mark did a premarital agreement for me and he did it very quickly. The price was fair and I would recommend him to my friends. He advised me and recommended what to include. I would highly recommend him to anyone needing a lawyer.
