Unless you and your spouse make a legally binding agreement otherwise, your state laws dictate the property rights in the event of divorce.

 

Prenuptial agreements and postnuptial agreements serve essentially the same purpose. Prenuptial signifies an agreement created before a marriage or civil union; a postnup is created thereafter. Many couples today hire lawyers to prepare prenuptial and postnuptial agreements for a number of reasons:

  • To define particular assets acquired during the marriage as separate property or as part of the marital estate
